Kane Footwear, LLC (“Kane” or “we”) is committed to respecting the privacy rights of our visitors. The purpose of this privacy policy is to describe the kinds of information that we may gather about you, how we may use that information, how we protect it, when we may disclose it, and the choices you have regarding your information.

Information that we collect

We may automatically collect non-personally identifiable information from you when you visit the Web Properties. This information includes your internet protocol ("IP") address, which is a number automatically assigned to your computer whenever you access the Internet. The IP address does not identify your name, email address, or other personal information. We use your IP address to help diagnose problems with our server and to administer our Site.

We may also collect non-personally identifiable information through the use of cookies. A cookie is an alphanumeric file that a web site puts on your hard drive so that it can remember something about you while you are using the Web Properties or when you return to the Web Properties. Cookies work in combination with content within the Web Properties to capture and remember information and Cookies make it easier for you to use the Web Properties. This enables us to provide you with services or to improve your experience. If you turn cookies off, you won’t have access to many features that make your site experience more efficient — like the features mentioned above and some of our services will not function properly.

Kane, its advertisers and ad servers may also use cookies, as well as files called "Web beacons" or "clear gifs" to determine on an anonymous basis which advertisements and promotions our Site users have seen and how users responded to them. We also receive and store click-stream data and other information about visits to our websites. This information is used to analyze and improve the website experience.

How do you collect my personal information?

We may collect your personally identifiable information, such as your name, shipping address, billing address, email address, phone number and credit card information, when you register for our Web Properties, when you complete a transaction, verify your credit card, arrange for delivery or return a purchase, enter a contest or promotion, respond to a survey or marketing communication, surf the website, or use certain features on the Web Properties.

Can we obtain your information from other sources?

Yes. Information that you give us may be combined with other personally identifiable information (such as order history and demographic information) from third-party sources to make our marketing efforts more efficient. Examples of other information we receive from third-party sources include updated delivery and address information, which we use to correct our records and deliver your next purchase or marketing materials more easily.

Kane may give you the option to connect your social media profile to the Web Properties or to your account. If you choose to do this, you give the social media site permission to share with us certain information about you, such as your email address and name.

Kane may also use third party analytics services, such as Google Analytics, in connection with the Web Properties. Such third-party services may use cookies and similar technologies to collect and analyze information about use and to report on activities and trends. Such services may also collect information regarding the use of other websites, applications, and online resources. Third-Party Services

We may receive your information from or share your information with third parties including but not limited to our agents, service providers, third party marketing partners, and consultants as needed for them to provide business-related services to us. Such third parties may manage our customer information and perform services on our behalf, such as website hosting, payment processing, order fulfillment, fraud monitoring, identity verification, processing credit card payments, email or mail delivery and administration, commercial delivery, promotion fulfillment, surveys or data analysis, generation of lists of new potential customers, etc. We or our partners may also combine your information with publicly available information and information that we receive from or cross-reference with partners.

In general, the third-party providers used by us will only collect, use and disclose your information to the extent necessary to allow them to perform the services they provide to us. However, certain third-party service providers, such as payment gateways and other payment transaction processors, have their own privacy policies in respect to the information we are required to provide to them for your purchase-related transactions. For these providers, we recommend that you read their privacy policies so you can understand the manner in which your personal information will be handled by these providers.

In particular, remember that certain providers may be located in or have facilities that are located a different jurisdiction than either you or us. If you elect to proceed with a transaction that involves the services of a third-party service provider, then your information may become subject to the laws of the jurisdiction(s) in which that service provider or its facilities are located. As an example, if you are located in Canada and your transaction is processed by a payment gateway located in the United States, then your personal information used in completing that transaction may be subject to disclosure under United States legislation, including the Patriot Act.

Once you leave our store’s website or are redirected to a third-party website or application, you are no longer governed by this Privacy Policy or our website’s Terms of Service.

What do we do with your information?

Financial information that is collected is used to bill you for products that you request.

Contact information from the order form is used to send orders and information about Kane to you.

If you register for email or if you provide your email address to us, we will send you emails. These emails will inform you of our launch of new products, of special sales, of promotional offers from our partners, and other information that you may find of interest, and of other events taking place in our stores near you.

We use your shipping address to ship your products to you and we may send marketing mailings to you. We use your billing address, if different than your shipping address, to verify your billing information. We never share our customer names or addresses, e-mail addresses or other personally identifiable information, other than to the extent described below. If you do not wish to receive mailings from us, please see the "How do I withdraw my consent?” section below.

We also use information we collect about you to (i) personalize your experience when visiting the Web Properties, (ii) administer a contest, promotion, survey or other site feature, (iii) allow us to better service you in responding to your customer service requests, (iv) obtain feedback, and (v) learn about your visit to the Web Properties and to tailor specific features, promotions, or other notifications to you.

Do we disclose your personal information?

Kane does not disclose your personal information to other companies, persons or agencies, except as listed below.

Service Providers: Kane employs other companies and individuals to perform certain services and functions on our behalf. Examples may include operating and maintaining our Web Properties, order processing and/or fulfilment, delivering packages, sending postal mail and email, removing repetitive information from customer lists, analyzing data, providing marketing consultation and assistance, distributing customer surveys, processing credit card payments, and providing customer service. These companies have access to personal information needed to perform their services or functions, but may not use it for other purposes.

Sharing: Kane may share your name and postal address with other reputable companies so they may send you catalogs about products of potential interest. We do not share credit card information or email address with these third parties. For Your Protection and Ours: Kane may release personally identifiable information when we believe it is appropriate to comply with applicable law, rules, regulation, legal process, orders, or governmental request; enforce or apply our Terms of Use and other agreements; or protect the rights, property, or safety of Kane, our customers, our employees or others.

Business Transfers: Kane may sell or buy subsidiaries or business units. In such transactions, customer information generally is one of the transferred business assets but remains subject to the promises made in any pre-existing privacy policy. If Kane is acquired, customer information will of course be one of the transferred assets.

With Your Consent: Other than as set out above, you will receive notice when information about you might go to third parties, and you will have the opportunity to choose not to share the information.

How do I withdraw my consent?

You have some choices about how we collect or use your information. The following explains some of those choices.

  • Do Not Track Mechanisms.Your browser may give you the option to turn on a “Do Not Track Signal.” The Web Properties do not respond to all Do Not Track signals from all browsers, as we need to use some signals for internal uses, like completing your purchases.
  • Emails.You can unsubscribe from, or change your preferences for, our marketing emails. To do so, click the unsubscribe link at the bottom of our marketing emails. Also, please note that if we have variations of your contact information (for example, more than one spelling or record of your name, address, or more than one email address, etc.) you will need to ask us to remove each such variation in order to be completely removed from our promotional lists.

Even if you opt out of receiving promotional communications, we may continue to send you non-promotional emails, such as those about your account or orders you have placed. Please note that when you make an online purchase from us, we will continue to confirm your order status and shipment by email, even if you have previously unsubscribed. We may also need to contact you via telephone, email or postal mail with questions or information regarding your order.

Children’s Privacy

The Web Properties are not intended or designed to attract children under the age of thirteen (13). You affirm that you are more than eighteen (18) years of age, or you are an emancipated minor, and are fully able and competent to enter into the terms, conditions, obligations, affirmations, representations, and warranties set forth in this Privacy Policy, and to abide by and comply with this Privacy Policy. In any case, by using the Web Properties, you affirm that you are over the age of thirteen (13), as THE WEB PROPERTIES ARE NOT INTENDED FOR CHILDREN UNDER THIRTEEN (13) WHO ARE UNACCOMPANIED BY THEIR PARENT(S) OR LEGAL GUARDIAN(S).

Parents and legal guardians should be aware that this privacy policy will govern our use of personal Information, but also that information that is voluntarily given by children (or others) in email exchanges, bulletin boards, or the like, may be used by other parties to generate unsolicited communications. We encourage all parents and legal guardians to instruct their children in the safe and responsible use of their Personal Information while using the Internet.

Shopify

Our store is hosted on Shopify Inc. They provide us with the online e-commerce platform that allows us to sell our products and services to you.

Your data is stored through Shopify’s data storage, database and the general Shopify application. Shopify Stores your data on a secure server behind a firewall.

Payment

If you choose a direct payment gateway to complete your purchase, then Shopify stores your credit card data. It is encrypted through the Payment Card Industry Data Security Standard (PCI-DSS). Your purchase transaction data is stored only as long as is necessary to complete your purchase transaction. After that is complete, your purchase transaction information is deleted. All direct payment gateways adhere to the standards set by PCI-DSS as managed by the PCI Security Standards Council, which is a joint effort of brands like Visa, MasterCard, American Express and Discover. PCI-DSS requirements help ensure the secure handling of credit card information by our store and its service providers. Public Forum

The Web Properties may make available chat rooms, blogs, and message boards. Please remember that any personal information or other information that you disclose in these areas, whether intentionally or inadvertently, becomes public information, and you should exercise caution when deciding to disclose any information, including, but not limited to, your personal information.

Security

To protect your personal information, we take reasonable precautions and follow industry best practices to make sure it is not inappropriately lost, misused, accessed, disclosed, altered or destroyed. If you provide us with your credit card information, the information is encrypted using secure socket layer technology (SSL) and stored with an AES-256 encryption. Although no method of transmission over the Internet or electronic storage is 100% secure, we follow all PCI-DSS requirements and implement additional generally accepted industry standards.

Choices Under the California Consumer Privacy Act

California residents have specific rights regarding their information. This section describes those rights and how to exercise them.

Selling Information.In the past 12 months, Kane has sold or disclosed the following categories of personal information from California consumers: identifiers, online activity, financial information, and commercial information. Kane sells your information, as defined by California law when we share it with advertising vendors who use it to help us provide you with relevant advertising. We do not sell your information for any other purpose. We do not and will not knowingly sell personal information of minors who are younger than 16.

Requests.As a California resident, you can make the following requests:

  • Access Requests.You can request that we disclose certain information to you about our collection and use of your personal information in the past 12 months. Once we receive and verify your request, we will give you the following information:
    • The categories of personal information we collected about you.
    • The categories of sources of personal information we collected about you.
    • Our business or commercial purpose for collecting or selling that personal information.

The Kane Footwear mobile message service (the "Service") is operated by Kane Footwear (“Kane Footwear”, “we”, or “us”). Your use of the Service constitutes your agreement to these terms and conditions (“Mobile Terms”). We may modify or cancel the Service or any of its features without notice. To the extent permitted by applicable law, we may also modify these Mobile Terms at any time and your continued use of the Service following the effective date of any such changes shall constitute your acceptance of such changes.

By consenting to Kane Footwear’s SMS/text messaging service, you agree to receive recurring SMS/text messages from and on behalf of Kane Footwear through your wireless provider to the mobile number you provided, even if your mobile number is registered on any state or federal Do Not Call list. Text messages may be sent using an automatic telephone dialing system or other technology. Service-related messages may include updates, alerts, and information (e.g., order updates, account alerts, etc.). Promotional messages may include promotions, specials, and other marketing offers (e.g., cart reminders).

You understand that you do not have to sign up for this program in order to make any purchases, and your consent is not a condition of any purchase with Kane Footwear. Your participation in this program is completely voluntary.

We do not charge for the Service, but you are responsible for all charges and fees associated with text messaging imposed by your wireless provider. Message frequency varies. Message and data rates may apply. Check your mobile plan and contact your wireless provider for details. You are solely responsible for all charges related to SMS/text messages, including charges from your wireless provider.

You may opt-out of the Service at any time. Text the single keyword command STOP to +18333246570 or click the unsubscribe link (where available) in any text message to cancel. You'll receive a one-time opt-out confirmation text message. No further messages will be sent to your mobile device, unless initiated by you. If you have subscribed to other Kane Footwear mobile message programs and wish to cancel, except where applicable law requires otherwise, you will need to opt out separately from those programs by following the instructions provided in their respective mobile terms.

To the extent permitted by applicable law, you agree that we will not be liable for failed, delayed, or misdirected delivery of any information sent through the Service, any errors in such information, and/or any action you may or may not take in reliance on the information or Service.

Changes to this Privacy Policy 

We reserve the right to modify this privacy policy at any time, so please review it frequently. Changes and clarifications will take effect immediately upon their posting on the website.
